Legislation reintroduced to boost prescribed fire activities

$600 million could be appropriated

Legislation that did not pass in Congress last year to promote prescribed fire was reintroduced yesterday by four Senators. The National Prescribed Fire Act of 2021 would appropriate $300 million each to the Departments of the Interior (DOI) and Agriculture (DOA) to increase the pace and scale of controlled burns on state, county, and federally managed lands. Companion legislation with four sponsors was introduced in the House of Representatives.

Of the total of eight sponsors and co-sponsors, seven are Democrats and one is Republican. The legislation did not stand a chance in 2020 but it could fare better this year.

Senators have issued press releases promising that if the bill is passed it “would help prevent the blistering and destructive infernos from destroying homes, businesses and livelihoods.” ?

The legislation:

  • Establishes a $10 million collaborative program, based on the successful Collaborative Forest Landscape Restoration Program, to implement controlled burns on county, state and private land at high risk of burning in a wildfire.
  • Establishes an incentive program to provide funding to state, county, and federal agencies for any large-scale controlled burn.S tates and counties could receive up to $100,000 for prescribed fire projects.
  • Establishes a workforce development program at the Forest Service and DOI to develop, train, and hire prescribed fire practitioners, and establishes employment programs for Tribes, veterans, women, and those formerly incarcerated.
  • Directs the DOI and DOA to hire additional personnel and procure equipment, including unmanned aerial systems equipped with aerial ignitions systems, in order to implement a greater number of prescribed fires.
  • Encourages large cross-boundary prescribed fires exceeding 50,000 acres.
  • Sets an annual target of at least one million acres treated with prescribed fire by federal agencies, but not to exceed 20 million.
  • Requires that by September 30, 2023 a minimum of one prescribed fire to be conducted on each unit of the National Forest System, unit of the National Wildlife Refuge System, unit of the National Park System, and Bureau of Land Management district under the jurisdiction of the two Departments. The intent is to increase familiarity with prescribed fire in local units.
  • The two Departments shall hire additional employees and provide training and development activities, including through partnerships with community colleges, to increase the number of skilled and qualified prescribed fire practitioners in the DOI, DOA, Indian Tribes, and other qualified organizations, including training in smoke management practices.
  • The Office of Personnel Management shall give the two Departments new authority to hire temporary personnel to perform work related to prescribed fire, including training, implementation, and post-prescribed burning activities. The workers could begin three days before the project and work through three days after “the prescribed fire has stopped burning.”
  • Overtime payments for prescribed fire could be paid out of wildfire suppression accounts.
  • Each Department shall create at least one crew for implementing prescribed fires. After a person works on the crew for five seasons they would become eligible for noncompetitive conversion to a permanent position.
  • The Departments may spend up to $1 million in working with the National Governors’ Association to host a conference to discuss the benefits of addressing liability protection related to prescribed fires, and possible incentives for States to enact a covered law.

“In the simplest terms, the National Prescribed Fire Act offers a legislative solution to increase the use of prescribed fire,” said National Association of State Foresters President, Arkansas State Forester, Joe Fox. “With this bill, state foresters would be able to maximize their utilization of controlled burns to enhance forest health while minimizing damages and mega smoke emissions from catastrophic wildfires. It is a win-win-win for forests, wildland fire management, and public health.”

The agency issues statement about compensation, recruitment, and retention for wildland firefighters

I was working on an article for Wildfire Today about the difficulties the federal land management agencies are having trying to recruit and retain firefighters while their employment packages pale in comparison to similar jobs in some state or municipal organizations. I sought out a spokesperson for the U.S. Forest Service (FS) in California, Jonathan Groveman who works out of their regional office, asking for specific numbers of firefighter positions in the state that can’t be filled.

About 20 hours after we last spoke, Mr. Groveman sent an email with a rather extraordinary official statement. There were no detailed numbers like I requested, but what was sent instead was six paragraphs that indicated that the FS, or at least Mr. Groveman, recognizes some of the issues that are beginning to seriously cripple the ability of the five federal land management agencies to protect the homeland from wildfires.

When Forest Service Chief Vicki Christiansen testified before a House Appropriations Subcommittee on April 17 she squandered two clear opportunities to accept or ask for more funding in two very important inadequately budgeted areas, fuels treatment and aerial firefighting. It was not clear if the Chief selected that strategy because her chain of command in the Department of Agriculture and the White House demanded that she remain agnostic about adequate funding for those areas, or if she took it upon herself to remain meek, adopting a don’t-make-any-waves posture. If it was the latter, the Chief needs to find another job.

At that point it looked hopeless to expect the Forest Service to be proactive about requesting Congress to provide badly needed funding for protecting our homeland from fires.

It appears that Chief Christiansen will get an opportunity for a do-over on May 26 before the same subcommittee in a hearing titled, “Rethinking Resiliency: Budgeting for the Future of Forest Management.”

In order to solve a problem, first it must be identified — which is tough to do with one’s head buried in the sand.

Mr. Groveman’s statement identified some of the issues that are seriously degrading the effectiveness of federal wildland firefighting. Assuming it represents the stance of the agencies and the White House, the next step is for Senators and Congressmen to work with the agencies to make sure they have the tools needed to do their jobs.  Here are some of the highlights — quotes from the document. Following those, is the complete statement.

We have seen key highly trained personnel leave the Forest Service and we have also experienced some inability to recruit new employees into the agency, which we understand is due to wage disparities with the states.

  • “In order for us to remain competitive we need to create a structure for establishing a wage that creates greater parity. This would enable us to maintain the necessary firefighting workforce necessary to meet wildland fire response expectations.”

Maintaining our ability to hire and retain firefighters as we see the complexity of the firefighting environment grow exponentially, has been further complicated by our inability to offer competitive wages. Federal wages for firefighters have not kept pace with wages offered by state, local and private entities in some areas of the United States. We have seen key highly trained personnel leave the Forest Service and we have also experienced some inability to recruit new employees into the agency, which we understand is due to wage disparities with the states.

We are committed to ensuring that Federal firefighters are properly compensated and recognized for the work they do and the administration is focused on equity in all forms. These problems are not unique to the Forest Service and also apply to firefighters within the Department of the Interior.

This is not about minimum wage but about a competitive wage. Particularly in states like California we are seeing that federal wages for firefighters is about half of what they would get for similar jobs in state and private entities. In order for us to remain competitive we need to create a structure for establishing a wage that creates greater parity. This would enable us to maintain the necessary firefighting workforce necessary to meet wildland fire response expectations.

We are working with OPM and OMB to evaluate options to modernize the firefighting workforce compensation structure, including job series, pay grade levels, and other changes.

In light of these challenges the Forest Service still maintains a robust and highly capable wildland fire workforce and will be able to meet the demands of what is expected to be another challenging fire year. We work with our federal, state, tribal, local and private partners to be sure we can access all available resources to respond to wildfires as needed.

The Forest Service is focused on creating a more modern firefighting workforce where we have specialized year round capability to respond to the wildfires conditions of not only today but into the future. This includes greater utilization of technology to enhance firefighter capability, effectiveness and safety.

Senate unanimously passes Washington state’s wildfire legislation

The bill enhances wildfire suppression capability, forest health, and community resilience

Legislation appropriating additional funding to beef up Washington state’s wildland fire suppression capability on the ground and in the air passed unanimously in the Senate Friday. It had already passed the House in the same manner and now heads back to the House which will accept or reject the changes made in the Senate. The legislative session is slated to adjourn April 25.

The number of acres burned in Washington wildfires last year, 812,000, was more than four times the average in the 2000s. In eastern Washington, 80 percent of the buildings were destroyed by the Babb-Malden Fire in September, 2020. The number of acres blackened in  Oregon last year, just across the border, was the second highest ever recorded.

The bill appropriates $125 million for the Department of Natural Resources to create for the first time a dedicated fund to suppress and mitigate wildfires over the next two-year budget period.

A similar bill was introduced last year but failed to pass, possibly because it also stipulated that a portion of the funds would be raised by establishing a surtax on home insurance premiums. This latest version left it up to the legislators to come up with a source for the money.

For two of the last three years, Washington had the worst air quality in the world due to smoke from wildfires.

The requested funds can be sorted into four categories:

Wildfire Response — $75.2 million

The bill creates positions for 100 more firefighters, adding three 20-person hand crews, 20 dozer operators, and two 10-person “post-release” crews comprised of formerly incarcerated persons who served on state fire response crews.

The bill also allows the purchase of two intelligence gathering fixed wing aircraft to be used on fires. Their ten very old UH-1H Huey helicopters would receive upgrades of some systems including night-flying capabilities. Washington does not own any air tankers, but in 2020 they had approximately six privately owned single engine air tankers (SEATS) on contract.

Forest Restoration — $31.4 million

The legislation fully funds and accelerates the DNR’s 20-Year Forest Health Strategic Plan, which calls for restoring natural wildfire resistance to 1.25 million acres of forest.

Workforce Development — $5.9 million

Provides career pathways for foresters, firefighters and mill workers.

Community Resilience — $12.6 million

Makes investments at the home, neighborhood, and community levels to reduce wildfire risk and protect communities. Includes investments in defensive strategies at the community level such as fuel breaks, prescribed fire, and creating defensible green space, plus direct assistance to home owners to secure their property and neighborhood with programs like FireWise.

Bill introduced to raise the max-out limit on overtime pay for federal employees

For some senior-level fire personnel their pay stops after working a certain number of overtime hours

Senator Diane Feinstein has introduced the Wildland Firefighter Pay Act, a bill that would raise the maximum limit on overtime pay for federal firefighters. The current limit affects higher level employees at the GS-12 and above level, and some GS-11s depending on if they are exempt from the provisions in the Fair Labor Standards Act. Under the existing provisions if they work hundreds of hours of overtime they may reach the cap after which they earn no more money. In some cases later in the fire season employees who spent a lot of time fighting fires have been told they earned too much and were forced to pay some of it back.

The proposed legislation eliminates the existing annual and pay period limits and creates a new one that places the maximum annual pay including overtime at Level II of the Executive Schedule, which in 2020 was $197,300.

“The current overtime pay cap for these brave men and women is outdated and represents a significant hurdle in retaining our most-experienced firefighters,” Senator Feinstein said. “Lifting this cap would ensure that these first responders are fairly paid for their hard work while helping build a federal firefighting service that can meet the challenges of our ‘new normal’ when it comes to wildfires.”

The Forest Service estimates that up to 500 senior-level firefighters either stop participating or do not request pay for hours worked once they reach the pay cap. This has a significant effect on federal wildfire response capabilities.

Senator Feinstein’s press release did not mention raising the pay of the federal wildland firefighters who live paycheck to paycheck.

UPDATE Oct. 26, 2021. The Senate bill has a number now:  S.138 – Wildland Firefighter Fair Pay Act, introduced January 28,2021; no other action has been taken.  The House of Representatives version of this bill is H.R.4274 – Wildland Firefighter Fair Pay Act, introduced June 30, 2021, and has been referred to two committees.  A hearing will be held Oct. 27, 2021 before the House Subcommittee on National Parks, Forests, and Public Lands.

Congress passes funding bill for federal firefighting agencies

The legislation pushes, again, for the implementation of tracking system for fire resources, due by March 12, 2021

Both houses of Congress passed a 5,600-page omnibus spending package Monday night to fund numerous programs that included the Departments of Agriculture and Interior along with COVID-19 relief. It the bill is signed by the President it will fund the agencies during the fiscal year that began October 1, 2020.

There are no major changes in the appropriations for wildland fire activities that employ approximately 15,000 forestry and range technicians whose primary duties are fighting wildfires. But there are some interesting issues that were highlighted, not in the text of the bill itself, but in the “explanatory statement” that elaborates on Congress’ oversight of the fire programs in the Forest Service, Bureau of Land Management, National Park Service, Fish and Wildlife Service, and Bureau of Indian Affairs.

Firefighting Technologies

Congress reminded the five agencies that the John D. Dingell, Jr. Natural Resources Management Act that passed overwhelmingly in both houses almost two years ago requires that by March 12, 2021 they develop and operate a tracking system to remotely locate the positions of fire resources. According to a press release by Senator Maria Cantwell at the time, by the 2021 fire season all firefighting crews – regardless of whether they are federal, state, or local – working on large wildfires will be equipped with GPS locators. By September 8, 2019 they were also supposed to develop plans for providing real-time maps of the location of fires. We have referred to knowing the real time location of both the fire and firefighters working on the fire as the “Holy Grail of Wildland Firefighter Safety.”

Apparently worried that the five agencies may be dragging their feet in following the requirements in the bill (which became law), Congress very, very politely issued a reminder in the explanatory statement:

The Committee encourages increased investment in these technologies within the funds provided for Forest and Rangeland Research and for preparedness activities in Wildland Fire Management. The Committee encourages prioritizing the use of commercial, off-the-shelf solutions, including mobile MESH networking technology, that provide situational awareness and interoperable communications between federal, state, and local firefighting agencies.

Longer contracts for firefighting aircraft?

The explanatory statement has a surprisingly lengthy section that directs the Forest Service and the DOI to submit a report within 90 days that lays out the considerations of awarding 10-year contracts for aircraft available for wildland fire suppression activities. If the President signs the bill today, the report would be due March 22, 2021.

The Next Generation 3.0 contracts for five large air tankers announced in October are for only one year with the possibility of up to four more years at the discretion of the FS.

Move the Forest Service Fire and Aviation section out of State and Private Forestry

More than half of the entire budget of the Forest Service goes to Fire and Aviation Management (FAM). But if you were trying to find FAM on the agency’s organization chart, it may take a while.

The first version of the appropriations bill introduced in the Senate required that FAM be moved out of State and Private Forestry and put in it’s own branch, with the Director of FAM becoming a Deputy Chief:

Commensurate with the modernized budget structure included in this Act, the Forest Service shall realign its Deputy Chief Areas to conform to the appropriations provided herein, including the creation of a Deputy Chief for Fire and Aviation to administer the Wildland Fire Management appropriation, within one year of enactment of this Act.

In November the National Association of State Foresters wrote a letter to the House and Senate appropriations leadership opposing the concept:

While we agree more must be done to minimize the threat of catastrophic wildfire, we are concerned that establishing a Deputy Chief for Fire and Aviation would divert valuable resources  from land management activities that reduce the threat of wildfire, only to establish additional bureaucracy around wildfire suppression… Establishing a Deputy Chief for Fire and Aviation is tantamount to building a “fire agency” and therefore contrary to the intent of the “Wildfire Funding Fix,” which Congress passed to free up funding for more active forest management.

The final version of the bill that passed Monday night eased off on that requirement, suggesting the agency just think about it:

The Committees are interested in data and recommendations relating to any changes that could be made to improve the representation of Wildland Fire Management leadership under this structure and the potential creation of a new Deputy Chief for Fire and Aviation. The Committees recognize that wildland fire related activities touch every aspect of the agency and believe that providing the fire function with a senior leadership role at the Service will improve coordination and better represents the role fire plays in agency budgeting and decision making.

Last week before the new language became available Monday night I checked with some fire management folks, asking their thoughts about the requirement, at the time, of promoting FAM to be their own branch with a Deputy Chief for Fire and Aviation. Here are their responses, in some cases edited for brevity:

Tom Harbour, former Director of FAM for the Forest Service:

The language is controversial. Specific organizational language like this is not popular with any federal organization. Based on just budget, the FAM program has been “Deputy Chief eligible” for a couple decades, but more goes into significant organization change decisions than budget. Five different Chiefs (Bosworth, Kimball, Tidwell, Tooke, Christiansen) have had the budget facts in front of them and have decided NOT to make a change.  The most obvious immediate question is what would happen with S&PF programs, and what happens with the important relationships with State Foresters?

Greg Greenhoe, former Deputy Director of Fire and Aviation Management for the Northern Region, USFS

I really don’t know enough about the issue to have an opinion. I can understand the concern of the State Foresters with Fire Management leaving State and Private. But even when I was still working I always thought it was strange that Fire was under State and Private. I can see that some folks would be concerned that the largest single budgeted function in the FS doesn’t have its own Deputy Chief.

Due to the fact that the wildland fire budget for suppression and preparedness is an overwhelming part of the entire USFS budget, this new proposed Deputy Chief of Fire and Aviation Management (FAM) position reporting directly to the Chief of the USFS leads to better accountability between the Chief of the USFS and the Fire and Aviation program.  Much needed modern reforms and developing a “National Fire Plan 2.0” will need to be closely linked between the Chief of the USFS and the Dep Chief of FAM. State and Private Forestry will continue to be an important part of the USFS overall program with or without the Fire Director working directly for the Deputy Chief of SPF.
