The number of USFS firefighters in California plunged 20% in two years

The federal agencies that employ firefighters to suppress wildfires have struggled to hire enough personnel in recent years, but especially in 2020 and 2021 in California. Today the San Francisco Chronicle (subscription) reported that after having 5,000 firefighters for multiple years in California the number working for the U.S. Forest Service dropped from 5,000 in 2019 to 3,956 in 2021, more than a 20 percent decline.

The five federal agencies that have significant wildland fire programs have a total of about 15,000 positions related to fire. In the last few years the number of vacancies has been growing due to difficulty in hiring and experienced firefighters leaving the organization for better pay and working conditions.

Legislation pending before Congress, the Tim Hart Wildland Firefighter Classification and Pay Parity Act (H.R. 5631), could make a difference. It would address many of the heartbreaking issues wildland firefighters and their partners face, including raising firefighter pay, creating a wildland firefighter job series, providing health care and mental health services to temporary and permanent wildland firefighters, housing stipends, and other improvements. Indications are that filling wildland firefighter positions this season is even more difficult than last year

As the western states were entering the busiest part of the wildland fire year in 2021 a U.S. Forest Service document written June 22 said that of the approximately 110 Federal hotshot crews, 25 percent, or about 27 crews, were not able to meet the required standards due to vacant positions. The San Francisco Chronicle reported that last year dozens of wildland fire engines across the state sat idle and others had to cut back to only five days a week because of a shortage of firefighters.

There are indications that the 2022 fire year could see even worse staffing shortages according to an article in Politico:

In an email obtained by POLITICO, Forest Service officials are already warning employees in California that there have been 50 percent fewer applications submitted for GS3 through GS9 firefighting positions this year compared to last. And regional Forest Service officials from across the Western fire regions reported struggling with low staffing on a Feb. 15 call with Fire and Aviation Management, the minutes of which were obtained by POLITICO. “Hiring frenzy – lack of candidates, unable to staff 7 days in many places. Continued decline of folks to do the work,” the minutes read, describing comments made by Regional Fire Director Alex Robertson.

Survey of spouses of wildland firefighters identifies issues facing families

60% report that their partners have been impacted by an incident at work that resulted in mental health challenges

The Grassroots Wildland Firefighters (GWF) group has released information about their latest effort to focus on the issues of mental health and comprehensive well-being of firefighters.

In the summer of 2021, GWF made an anonymous survey available to partners and spouses of federal wildland firefighters. In completing the survey, 1,841 respondents shared their experiences as the loved one of a federal wildland firefighter, shedding light on what it’s like to raise a family, manage a household, and support firefighters battling mental health issues.

The results were astounding, according to the GWF. They revealed that:

  • 73.1% of respondents regularly worry about the possibility of a tragic accident on the fireline. And 65.4% lack confidence in the agency to take care of them if something were to happen to their partner while on duty.
  • 60.2% report that their partners have been impacted by an incident at work that resulted in mental health challenges. Of those respondents whose partners reached out for help, only 2.8% strongly agreed that the agency’s Employee Assistance Program was helpful.
  • Extended absence physically and/or emotionally was the number one stressor reported as “extremely impactful” to respondents.
  • For suggested areas of future support, wildland firefighters’ partners indicated that the top three areas they’d rate as “extremely helpful” were: higher pay to reduce financial stress (88.0%), year-round access to health care for seasonal firefighters (80.2%), and access to mental health professionals who understand fire culture (58.3%).

When given the opportunity to comment freely, survey respondents said things like:

  • “It is really hard being a partner to a wildland firefighter; his mental health has really deteriorated in the last few years. More stress with his newer roles and very little pay to compensate for it. There really aren’t enough resources for him to find help with the mental health issues he’s been having.”
  • “The mental health issues seem to have compounded over time with the nature of the job but also the loss of friends and co-workers to fire related deaths and suicide.”

The GWF said as another fire season begins it is urgent that Congress move forward in the House of Representatives to pass the Tim Hart Wildland Firefighter Classification and Pay Parity Act. (H.R. 5631). The legislation bears the name of a firefighter who died while working on the Eicks Fire in New Mexico in 2021. It would address many of the heartbreaking issues wildland firefighters and their partners face, including raising firefighter pay, creating a wildland firefighter job series, providing health care and mental health services to temporary and permanent wildland firefighters, housing stipends, and other improvements. “Tim would be humbled and honored to have this legislation be a part of his legacy,” said Smokejumper Tim Hart’s wife Michelle Hart. “These issues were deeply important and personal to him. Wildland firefighters deserve to be recognized and compensated for the grueling conditions in which they work and for putting their lives on the line every day. This legislation is a major step forward in achieving that goal.”

BC Wildfire Service moves to a year-round workforce

Minister of Finance Selina Robinson presented the 2022 budget for British Columbia on February 22, 2022.

The government of British Columbia intends to move to a year-round workforce for the Wildfire Service in the next fiscal year that begins April 1. In a February 22 presentation Minister of Finance Selina Robinson said, “$145 million in new funding will strengthen B.C.’s emergency management and wildfire services.  The BC Wildfire Service will shift from a reactive to a proactive approach by moving to a year-round workforce that will deliver all pillars of emergency management: prevention and mitigation, preparedness, response and recovery.”

The BC Wildfire Service employs approximately 1,000 wildland firefighters each year.

The new budget will allow improvements of the public alerting system for wildfires and help support people and communities during climate-related events.

An additional $98 million will fund wildfire prevention work and maintain forest service roads used to respond to forest fires.

The budget also includes $210 million to support community climate change preparedness and emergency management, including through the FireSmart program, the Community Emergency Preparedness Fund, and Indigenous-led emergency management priorities. It will support communities and First Nations to build more resilient dikes and map floodplains.

It seems like in the last year there has been more wildfire-related legislation introduced in Congress than in previous years. It’s hard to say why, but it could be related to a growing number of megafires, more communities destroyed, and increased activism in the wildland firefighter community.

Of course simply introducing legislation accomplishes nothing if it does not become law, except perhaps providing a talking point for the politician’s next reelection campaign. A cynic might suggest that some bills are introduced and press releases issued by members of Congress with no hope or expectation that they will pass. But it is difficult to tell which are real and which are vaporware.

With that in the back of our minds, here is a partial list of 15 bills and the dates they were introduced which have not passed in this 117th United States Congress (2021-2022). Only a few have made it to the committee hearing stage, and none have progressed beyond that.

H.R. 5631Tim Hart Wildland Firefighter Classification and Pay Parity Act. October 19, 2021. (Rep. Joe Neguse). This bill has numerous provisions, including raising firefighter pay, creating a wildland firefighter job series, providing health care and mental health services to temporary and permanent wildland firefighters, housing stipends, and other items. (More details are in the Wildfire Today article from October 19, 2021.)

H.R.5010FIRE Act. August 13, 2021. (Rep. Mike Garcia) This bill directs the National Oceanic and Atmospheric Administration (NOAA), in collaboration with the U.S. weather industry and and academic partners, to establish a program within NOAA to improve wildfire forecasting and detection.

H.R.2585FIRE Act of 2021. April 1,5 2021 (Rep. Dusty Johnson) Timber salvage sales. No later than 60 days after a wildfire is contained on such lands (1) the Forest Service, to the maximum extent practicable, shall complete a survey of the lands that were impacted by such wildfire; and (2) the Department of Agriculture (USDA) shall convert the timber sales applicable to such lands that were impacted by such wildfire to salvage sales. The bill designates a categorical exclusion for forest management activities where the primary purpose of the activity is for roadside salvage activities that allow for the removal of hazard trees that are within 200 feet of a roadway center line. Activities carried out pursuant to this bill shall be subject to judicial review in the same manner as authorized hazardous fuels reduction projects. A court may not order a preliminary injunction enjoining the USDA from proceeding with timber sales authorized under this bill.

S.3092FIRE Act. October 27, 2021. (Sen. Alex Padilla) The bill would, according to Senator Padilla, update the Stafford Act that governs FEMA—which was written when the agency primarily focused on hurricanes, tornadoes, and floods—to improve FEMA’s response to wildfires, including by accounting for “melted infrastructure” and burned trees as well as allowing FEMA to pre-deploy assets during times of highest wildfire risk and red flag warnings. The bill would also ensure cultural competency for FEMA’s counseling and case management services, help to ensure relocation assistance is accessible to public infrastructure in fire prone areas, prioritize survivors’ housing needs after disasters, ensure equity of assistance for tribal communities and tribal governments, and examine ways to speed up the federal assistance process and improve the availability of fire insurance. S.1734National Prescribed Fire Act of 2021. May 20, 2021. (Sen. Ron Wyden). The bill would appropriate $300 million each to the Departments of the Interior (DOI) and Agriculture (DOA) to increase the pace and scale of controlled burns on state, county, and federally managed lands. It sets an annual target of at least one million acres treated with prescribed fire by federal agencies, but not to exceed 20 million. It requires the two departments to hire additional employees. Overtime payments for prescribed fire could be paid out of wildfire suppression accounts. More info.

S.138Wildland Firefighter Pay Act. January 28, 2021. (Sen. Dianne Feinstein.) It would raise the maximum limit on overtime pay for federal firefighters. The current limit affects higher level employees at the GS-12 and above level, and some GS-11s depending on if they are exempt from the provisions in the Fair Labor Standards Act. Under the existing provisions if they work hundreds of hours of overtime they may reach the cap after which they earn no more money. In some cases later in the fire season employees who spent a lot of time fighting fires have been told they earned too much and were forced to pay some of it back. More info.

S.1116Federal Firefighters Fairness Act of 2021. April 14, 2021 (Sen. Thomas Carper.) Establishes for federal workers certain medical conditions as presumptive illnesses. Specifically, the bill provides that (1) heart disease, lung disease, and specified cancers of federal employees employed in fire protection activities for at least 5 years are presumed to be proximately caused by such employment if the employee is diagnosed with the disease within 10 years of employment; and (2) the disability or death of the employee due to such disease is presumed to result from personal injury sustained in the performance of duty. These presumptions also apply to fire protection employees (regardless of the length of employment) who contract any communicable disease at the center of a designated pandemic or any chronic infectious disease that the Department of Labor determines is related to job-related hazards.

H.R.6336Western Wildfire Support Act of 2021. December 20, 2021. (Joe Neguse.) Establishes a program to train and certify citizens who wish to be able to volunteer to assist USDA or Interior during a wildland fire incident, and a program to award grants to eligible states or units of local government to acquire slip-on tank and pump units for a surge capacity of resources for fire suppression. It requires the Joint Fire Science Program to carry out research and development of unmanned aircraft system fire applications.

S.2419Wildfire Smoke Emergency Declaration Act of 2021. (Sen. Jeff Merkley.) This bill authorizes the President to declare a smoke emergency and provide emergency assistance to affected communities under specified circumstances. Specifically, the President, upon determining that there is, or anticipating that there will be, a significant decrease in air quality due to wildland fire smoke in one or more states, may declare a smoke emergency. The governor or other agency of a state that is or will be affected may request such a declaration. If the President declares a smoke emergency, the Federal Emergency Management Agency (FEMA) and other federal agencies may provide emergency assistance to states and local communities that are or will be affected by the emergency, including grants, equipment, supplies, and personnel and resources for establishing smoke shelters, air purifiers, and additional air monitoring sites. The Small Business Administration may provide grants to any small business concern that loses a significant amount of revenue due to wildland fire smoke in an area in which the President has declared a smoke emergency.

S.2661Smoke-Ready Communities Act of 2021. August 5, 2021. (Sen. Jeff Merkley) Provides funding for infrastructure upgrades to public buildings to filter out wildfire smoke. It would also assist with local efforts to provide health information about wildfire smoke.

S.2421Smoke Planning and Research Act. July 21, 2021. (Sen. Jeff Merkley.) It would make available each year $80 million to fund research on the public health impacts of wildfire smoke and create a grant program for local community planning relating to wildfire smoke.

H.R.4614Resilient Federal Forests Act. (Rep. Bruce Westerman) Primarily related to the logging industry, it streamlines or avoids compliance with some requirements of the National Environmental Policy Act by establishing numerous categorical exclusions for projects on National Forest System and public lands. It does away with many of the environment regulations a logging company must satisfy before a timber sale takes place.

S.48721st Century Conservation Corps Act. (Sen. Ron Wyden.) The bill would provide funds to support a natural resource management and conservation workforce and bolster wildfire prevention and preparedness. Establishes a $9 billion fund for qualified land and conservation corps to increase job training and hiring specifically for jobs in the woods, helping to restore public lands and provide jobs in a time of need. Provides an additional $3.5 billion for the U.S. Forest Service and $2 billion for the U.S. Bureau of Land Management to support science-based projects aimed at improving forest health and reducing the risk of catastrophic wildfire. Establishes a $2 billion fund to provide economic relief for outfitters and guides holding U.S. Forest Service and U.S. Department of the Interior special use permits. Provides $2 billion for the National Fire Capacity program, which helps the Forest Service implement FireWise, to prevent, mitigate, and respond to wildfire around homes and businesses on private land. Provides $2 billion for the FEMA Building Resilient Infrastructure and Communities (BRIC) program to improve resiliency for communities impacted by wildfire. Provides $6 billion for U.S. Forest Service, $6 billion for the National Park Service, and $2 billion for the Bureau of Land Management maintenance accounts to create jobs, reduce the maintenance backlog, and expand access to recreation. S.2650Wildfire Resilient Communities Act. August 5, 2021. (Sen. Jeff Merkley.)  Sets aside $30 billion for the U.S. Forest Service and the Bureau of Land Management to boost catastrophic wildfire reduction projects. Provides financial and technical assistance to at-risk communities adjacent to Federal land, including through States, to assist the at-risk communities in planning and preparing for wildfire, including cosponsoring and supporting the expansion of the Firewise USA program, the Ready, Set, Go program, and the Living with Wildfire program.

Department of Interior outlines changes enabled by Infrastructure Bill

The legislation provides a historic $4.5 billion for federal wildland fire management programs

Last week the U.S. Department of Agriculture Forest Service outlined the changes the agency will implement in their fuels management program to reflect the large influx of funding in the Bipartisan Infrastructure Bill signed by the President November 15, 2021.

This week the Department of the Interior released information about how the funds will affect a range of Interior’s programs. Four agencies in the DOI have significant wildland fire responsibilities: National Park Service, Bureau of Land Management, Fish and Wildlife Service, and Bureau of Indian Affairs.

The law includes $1.2 trillion to rebuild America’s roads, bridges, and railways; expand access to clean drinking water; ensure every American has access to high-speed internet; tackle the climate crisis; advance environmental justice; and invest in communities that have too often been left behind.

A Historic Investment in Wildland Fire Management

The law is a once-in-a-generation investment, but you might be wondering what it has to do with wildfires. As part of the nation’s efforts to address climate change and support resilient, climate-adapted communities, BIL provides a historic $4.5 billion for federal wildland fire management efforts over the next five years.

Within the federal government, the Interior and Agriculture departments both administer wildland fire programs. The U.S. Department of Agriculture (USDA) Forest Service will receive an additional $3 billion through BIL while the Interior Department will receive approximately $1.5 billion for wildland fire management over the next five years. Both departments will coordinate closely to maximize the benefits of these additional investments.

What It Means

The Interior Department will dramatically expand its efforts to reduce wildfire risk, prepare for and respond to harmful wildfires, and support post-fire recovery, including in communities that have traditionally been overlooked. In 2022 alone, the Interior Department will invest an additional $407 million in wildland fire management.

Over the next five years, the primary investments will include:

Reducing Risk
The Interior Department will improve ecosystem health and remove fuel for wildfires on additional acreage using an additional $878 million.

Wildfire Recovery
With an additional $325 million, the Interior Department will expand burned area restoration activities.

Workforce Improvements
An additional $164 million will enable the Interior Department to improve firefighter classification, compensation, benefits, mental health resources, and training.

Technology and Equipment
With an additional $72 million, the Interior Department will improve the use of technology and equipment to detect and respond to wildfires.

Supporting Science
The Interior Department will invest an additional $10 million in the Joint Fire Science Program to identify and fund high-priority fire science research.

What Happens Next

The Interior Department, in collaboration with the USDA Forest Service, is currently developing plans for the strategic implementation of this historic investment.

We are focused on implementing these significant investments in forest and rangeland restoration, hazardous fuel management, wildfire preparation, and post-wildfire recovery as quickly and efficiently as possible. BIL includes aggressive timelines, which we are prepared to meet, and we will share updates throughout the year as our work progresses.
