Oregon Rx fire gets away east of Eugene

Firefighters are working on a wildfire that took off when sudden wind gusts fanned a prescribed burn that was considered contained, the U.S. Forest Service reported late Tuesday night. KEZI-TV reported that a prescribed burn was under way near the community of McKenzie Bridge, upstream from Eugene, Oregon, on the McKenzie River, on May 30. Though the prescribed burn was started when weather was within planned parameters, gusty winds started two spot fires near the 65-acre burn area.

The USFS officially declared the escaped burn a wildfire — called the W-470 Fire — and said that as of the morning of May 31 the total burn area was about 120 acres.

Fire crews went out on the night of May 30 to try to contain the fire. The USFS said 34 firefighters worked overnight according to pre-existing contingency plans, and more resources were on the way.

KLCC radio reported that unexpected gusty winds pushed the burn outside the prescribed area. The fire is about two miles northeast of the McKenzie River ranger station in eastern Lane County.

The Willamette National Forest reported that the burn was planned to reduce fuels in a thinned stand, but the escaped fire burned onto National Forest land outside of the burn unit’s perimeter. The burn area is north of Highway 126 where FS Roads 26-204 and 26-206 split near Frissell Trail.

Cooler temperatures are moderating fire activity. “Our highest priority is to suppress fire in the area adjacent to the burn unit,” said Dave Warnack, Willamette Forest Supervisor. Residents of the area who remember the 2020 Holiday Farm Fire are expressing frustration with the USFS for allowing the prescribed burn to escape.

Northeast News: RxFire, highway closure, and drone warnings

April in New Jersey was dry and windy enough for numerous Red Flag Warnings this past week, but the state Forest Fire Service still pulled off a prescribed burn and contained a wildfire.

Another New Jersey fire, the Kanouse Fire, burned 1000 acres in northern New Jersey, leading to evacuations — of five homes and 100+ animals from the Echo Lake Stables. Embers were reported to have started fires a half mile across Echo Lake, with the fire staffed by multiple agencies.

Though fire danger has been high to very high statewide in recent days, fire restrictions have been lifted in two of the three statewide zones as today’s calmer winds reduced fire risk.

Today’s date also marks 60 years since New Jersey’s “Black Saturday” on April 20, 1963, when 30-50 mph winds, humidity in the low 20s and temperatures in the low 80s fanned the rapid spread of 31 major fires that burned 190,000 acres, destroyed or damaged 400 structures, and evacuated 2500 residents.

Meanwhile, in Pennsylvania, after a week with the entire state in high fire danger, the southern and central zones are now in high fire danger and the rest of the state is classed as moderate.

This past weekend, according to Lehigh Valley Live, the 4000-acre Crystal Lake Fire east of Mountain Top led to the closure of 20 miles of the Pennsylvania Turnpike between the Poconos and Wyoming Valley interchanges.

Also during the weekend, a drone-airspace intrusion on the Peter’s Mountain Fire in Dauphin County was reported by WGAL-TV.  The report reminded people that interfering with firefighting operations on public lands, per the Federal Aviation Administration, can carry a 12-month prison term, and drone pilots who interfere with wildfire suppression could also receive a fine of more than $37,000.

To thin or not to thin … it’s really not a question

The largest wildfires in the West — often called mega-fires — have increased in both size and number in recent years. The fire season — in both length and severity — increases nearly annually. Severe wildfire — classed in various ways but often as fire that kills most of the trees in its path — has by some reports increased eightfold in 30 years.

Fire science and experience over decades of research and field practice have settled on a major prevention tool: fuels reduction. This term includes both thinning (mechanical removal of shrubs and mostly small trees) and prescribed burning (intentional introduction of fire under favorable conditions).

A recent issue of High Country News features a report by Emily Shepherd, a freelance writer who worked in wildlife conservation for eight years, followed by two years as a U.S. Forest Service hotshot. She explains that wildfire ecologists almost universally support fuels reduction, especially in forests that had previously flourished under frequent ground fires — such as the ponderosa pine forests of Arizona and the Southwest.

While there’s no serious cohort of scientific dissent, forest managers still struggle to put their fuels reduction knowledge and goals into practice. “Forest thinning” is the target of prolific misinformation from groups ranging from the simply uninformed to the nationally well-funded (and well lawyered up), while locals in the area where prescribed fire is planned often see rxfires as just a nuisance or annoyance. A cacophony of opinions based more on language than on science.To its opponents, thinning is a form of “silviculture by stealth,” as wildfire historian Stephen Pyne puts it; he says thinning is more like “woody weeding.” Logging harvests large, mature trees over large areas, he explains, while thinning mostly removes small trees. Logging makes money; thinning almost always costs money.

Thinning should be followed by prescribed fire. “If you don’t follow it up with the right fire, then it’s worthless,” says Pyne, “and in many cases may have made it worse.” Thinning and prescribed burning are the one-two punch that can knock out severe wildfires. Like everything, prescribed fires do have drawbacks: They are complicated to plan and execute, they dump unwanted smoke on nearby communities, they’re subject to litigation, and in rare instances they can ignite destructive burns or even get agency staff arrested.

“We conduct an average of 4,500 prescribed fire projects annually,” said USFS Chief Randy Moore in the spring of 2022, “and 99.84 percent go according to plan. That equals slightly more than one escape per every 1,000 prescribed fires, or about six escapes per year.”

As long as terms like “thinning” are used and abused by non-scientific groups with a bias, though, there will always be conflict. A report by Oregon Public Broadcasting not long ago was headlined “A southern Oregon conservationist’s wishlist for better collaboration with the BLM” in which Roman Battaglia, a reporter with Ashland-based Jefferson Public Radio, interviewed Luke Ruediger, executive director of Applegate Siskiyou Alliance, about the Medford area BLM’s latest forest management plan, known as the Integrated Vegetation Management Plan. “A lot of the problem that we see is that increasingly the federal government and federal land managers are not making that effort to communicate and collaborate or even to share basic information on federal land management projects with the public,” said Ruediger. “And that’s leading to a lot of issues surrounding trust.”

“It’s also creating a lot of situations where, essentially, the BLM is operating in secret and refusing to provide information on the projects that they’re designing on federal lands to the public that those projects would affect,” claimed Ruediger.

Opponents of thinning and other fuels treatment methods really need to take a look at the history of Lick Creek in Montana. The Lick Creek Demonstration – Research Forest studies were established back in 1991 in western Montana to evaluate tradeoffs among alternative cutting and burning strategies aimed at reducing fuels and moderating forest fire behavior while restoring historical stand structures and species compositions.

Firefighters and numerous studies over many years credit intensive forest thinning projects with helping save communities like those recently threatened near Lake Tahoe in California and Nevada, but dissent from some environmental advocacy groups still roils the scientific/environmental community. An Associated Press story out of Sacramento in October of 2021 noted that environmental advocates say data from recent gigantic wildfires support their long-running assertion that efforts to slow wildfires have instead accelerated their spread. “Not only did tens of thousands of acres of recent thinning, fuel breaks, and other forest management fail to stop or slow the fire’s rapid spread, but … the fire often moved fastest through such areas,” Los Padres ForestWatch, a California-based nonprofit, said in an analysis joined by the John Muir Project and Wild Heritage advocacy groups.

But James Johnston, a researcher with Oregon State University’s College of Forestry, called the groups’ conclusions “pretty misleading,” “irresponsible” and “self-contradicting.”

“Claims that modern fuel-reduction thinning makes fire worse are not credible,” Johnston said.

Chad Hanson is an ecologist with the John Muir Project and the author of Smokescreen: Debunking Wildfire Myths to Save Our Forests and Our Climate. “Wildfires can always turn tragic,” says Hanson, “but the greater tragedy in Greenville and Paradise, which was largely destroyed during the 2018 Camp Fire, and other towns is that they put their faith in logging operations miles away rather than proven, community-based fire prevention measures. Forest thinning is gaining more media attention and is heavily promoted by some land management agencies and logging interests, but science suggests the technique more often makes fires burn hotter and faster. The idea of felling trees and hauling them to lumber mills in the name of fire prevention has many deceptive names: fuel reduction, forest health, ecological restoration, thinning, and even reforestation.”

KGW-8 News reported on Johnston’s work with OSU, writing that the forestry sciences community forecasts massive wildfires like the ones that burned in Oregon last year will only get bigger and more severe. However, new research suggests that thinning the forests can go a long way toward preventing severe fires.  [ related: video ]

“This study shows that fuel reduction thinning to moderate fire behavior … works,” said Johnston. His research focused on a ponderosa forest in northeast Oregon, where his team compared thinned stands of trees with un-thinned control stands and then used computer modeling to predict the behavior of future fires. “Most fuel reduction projects in eastern Oregon thin from below and cut down the smaller trees and leave the old large fire-resistant trees,” Johnston said. “That leaves behind a forest that’s less dense, and our studies show it has a less far less fuel to burn in future fires.”

Johnston said the result is even better when prescribed burning is added. “The only way to fight fire is with more fire,” he said.

It’s easy to see why the influenceable public can become confused, with a wide range of communications and opinions about complex forest and fire management topics. But two rural Josephine County communities are working with federal fire managers, according to a report by KDRV-TV, to improve wildfire resilience in southern Oregon. The BLM recently issued its “decision to promote safe wildfire response, develop fire-resilient lands, and create habitat for special status species” for a project near the communities of Murphy and Williams, both south of Grants Pass.

The BLM project is called Late Mungers Integrated Vegetation Management Project. It includes prescribed fire, fuels thinning and selective harvest phases; over the next 10 years the BLM expects fuels reduction work on about 7,500 acres under this project.

Fire managers plan to start at strategic locations where firefighters have the best chance to catch and contain wildfires. The project also includes 830 acres of proposed harvests split into two timber sales: Late Mungers and Penn Butte. “By using selection harvest methods, these treatments will increase the diversity of the forest stands,” according to the BLM. “This more complex habitat is important for the northern spotted owl, the marbled murrelet and Pacific marten (federally listed as threatened under the Endangered Species Act), as well as other special-status species.”

During the project’s public comment period, the BLM collected more than 100 comments, and the project team hosted a field trip to the project area and held a public webinar to collect further input about the project. “Forests in Southwest Oregon are in dire need of active management to maintain and improve forest health,” said BLM District Manager Elizabeth Burghard in Medford. “The Late Mungers project is an important step toward promoting and developing complex forest habitats for the northern spotted owl and other sensitive species. This project will make the landscape, including legacy trees, more resilient to wildfire by addressing hazardous wildfire fuels near local communities.”

 

Forest Service Burn Boss arrested after prescribed fire escapes in Oregon

Late Friday afternoon Chief of the Forest Service Randy Moore sent an email to all Forest Service employees regarding the Wednesday October 19 arrest of a Burn Boss while conducting a prescribed fire that slopped over the Forest boundary, burning approximately 18 acres of private land.

“This week, there was an incident in the Pacific Northwest Region where a Forest Service Burn Boss was arrested while leading a prescribed fire that crossed over onto private lands,” the email read in part. “They were engaging in appropriate, coordinated, and vital prescribed fire work alongside state and other colleagues approved and supported by the Agency Administrator. In my opinion, this arrest was highly inappropriate under these circumstances, and I will not stand idly by without fully defending the Burn Boss and all employees carrying out their official duties as federal employees.  

This employee should not have been singled out, and we are working to address these unfortunate circumstances on their behalf,” Chief Moore continued. “This also prompted me to want to reach out to all of you and remind you of how important you are to the success of the Forest Service. You will always have my support and the same from your regional and local leadership. I will aggressively engage to ensure our important work across the country is allowed to move forward unhampered as you carry out duties in your official capacity.”

The arrest of the Forest Service Burn Boss while conducting a prescribed fire has been picked up by numerous news organizations, including Washington Post, Guardian, NBC News, ABC news, and Reuters.

To our knowledge this is the first time a federal government firefighter has been arrested at a fire for conducting their assigned duties.

Many of you have probably seen the news and social media coverage about one of our employees arrested for leading a prescribed fire that slopped over onto private lands. There’s a lot of context and additional information about this incident that would be inappropriate to share publicly at this time, but none of that information revolves around the work conducted during the prescribed burn, the professionalism of our employees, partners, and contractors, or how the burn sloped over onto private land.

While I can’t go into specifics around the arrest of the burn boss, I want each of you to know that all times he, and the entire team that engaged on the Starr prescribed fire, had, and continues to have, our full support.

Communication and coordination between all levels of the Forest Service and the department were effectively in place within hours of this incident. This included local, regional, and national level leadership, Fire and Aviation Management leaders, legal counsel, and law enforcement – which reflects our commitment to this important work and our promise to share in the accountability for any and all outcomes.

I spoke with the Burn Boss last night and expressed my support for him and the actions he took in leading the prescribed burn.  In addition, I let him know it’s my expectation that the Forest Service will continue to support him throughout any legal actions.

No one person or crew is in this work on their own. I need you to know that I am with you now and into the future, whatever that future may look like.

I trust and respect our firefighters and employees who carry out the complex and dynamic mission of applying fire treatments to the landscape. They are well-trained, well-informed, and well-equipped for the mission.

Grant County District Attorney Jim Carpenter identified the US Forest Service Fire Boss arrested as Rick Snodgrass after the Star 6 prescribed fire burned an unintended 18 to 20 acres of private land near the Malheur National Forest in Oregon.

“This case will be evaluated once the investigation is complete, and if appropriate, Snodgrass will formally be charged,” said Mr. Carpenter in a written statement. “These cases rarely have a bright line and involve a number of variables to be considered. However, to be clear, the employer and/or position of Snodgrass will not protect him if it is determined that he acted recklessly. That the USFS was engaging in a prescribed burn may actually raise, rather than lower the standard to which Snodgrass will be held.”

Grant County Sheriff Todd McKinley told Wildfire Today that when the Malheur National Forest’s Star 6 prescribed fire escaped control and spread onto the privately owned Holliday Ranch the ranch employees “were actually out helping them try to catch the fire and prevent it from doing more damage”, but at the same time some of them were “highly upset.”

Sheriff McKinley said the US Forest Service Burn Boss who was arrested and charged with Reckless Burning did not have to post bail, but met the criteria for “conditional release.” The Sheriff said Forest Supervisor Craig Trulock was at the Sheriff’s Office.

We asked the Sheriff about the report that the arrest was made to de-escalate a tense situation going on with armed private landowners.

“They may have been armed,” he said, “but we are not aware of that. There were definitely some landowners that were highly upset.”

“Determining the rest, honestly, Bill, is getting to the bottom of why they were even burning to begin with and why they chose to burn at that time,” the Sheriff said when we asked about the next step. “You know, there’s a lot more to this. Everybody knew it was a bad burn, should not be happening. Even the fire staff out there, there are fire personnel that were on scene that are afraid to say much because, you know, their jobs. It was not the right time to burn and there may have even been means taken to get that burn done that were outside the scope. That’s kind of where it’s at. You know, it’s a really tenuous situation and more details will come out.”

“The Forest Service employee referenced in the recent reporting  was conducting an approved prescribed fire operation on the Malheur National Forest,” the Public Affairs Officer for the Forest, Mary Hamisevicz, wrote in a text message. “It would be inappropriate for us to provide further comment as this is a legal matter.”

The weather recorded at the EW3547 Seneca weather station at 2 p.m. on October 19 was 73 degrees, 16 percent relative humidity, and mostly calm winds that occasionally gusted to 3 mph.

A US Forest Service employee serving as the Burn Boss on a prescribed fire was arrested Wednesday October 19 after the fire escaped and burned approximately 18 acres of private land.

The project was on the Malheur National Forest at mile post two on the Izee Highway between John Day and Seneca, Oregon.

Grant County Sheriff Todd McKinley issued a statement Thursday saying the escaped fire burned lands belonging to the Holliday Ranches on the “hot afternoon of October 19, 2022.”

The statement read in part:

The Grant County Sheriff’s Office arrested a 39-year-old Forest Service employee for Reckless Burning, and transported him to the Grant County Jail. The employee was assigned as the fire’s “burn boss.”

The Sheriff’s office said they are working with the Forest Service to determine the events that led to the escaped fire.

The Star 6 prescribed fire was intended to burn 362 acres. The US Forest Service said on Twitter the escape was caught within an hour at 18 acres, but failed to mention that the Burn Boss was arrested. The Sheriff said it burned approximately 20 acres.

Phone calls to Forest Supervisor Craig Trulock and Blue Mountain District Ranger Sally Christenson were not immediately returned.

This is the first time to this author’s knowledge that a Federal Burn Boss has been arrested for an escaped prescribed fire.

After the 2001 Thirtymile Fire, a Crew Boss was charged with 11 felonies related to the entrapment and burnover deaths of four firefighters who were on his hand crew. He was facing the possibility of decades in prison, but the Assistant U. S. Attorney, perhaps realizing he did not have a winnable case, allowed him to plead guilty to two misdemeanors of making a false statement in an Administrative hearing. Seven years after the fire, he was sentenced to three months of incarceration in a work-release program and three years of probation.

Forest Service Chief Randy Moore announced that the nearly four-month suspension on prescribed fires has been lifted after receiving the findings and recommendations provided by a National Review Team.

The suspension and review occurred after two prescribed fires on the Santa Fe National Forest in Northern New Mexico escaped in April, merged, and became the Calf Canyon – Hermits Peak wildfire that burned more than 341,000 acres and 903 structures. The area was later hit by flash floods which resulted in more damage. On September 18 the fire will transition from a Type 2 Incident Management Team to a Type 3 Team.

A report released by the Forest Service in June about the two escaped fires concluded the approved prescribed fire plan was followed for most but not all of the parameters. The people on the ground felt they were close to or within the prescription limits but fuel moistures were lower than realized and increased heavy fuel loading after fireline preparation contributed to increasing the risk of fire escape.

The National Review Team that evaluated the agency’s prescribed fire program produced a 107-page report which included seven recommendations. Chief Moore said in a statement, “I have decided to conditionally resume the Forest Service’s prescribed fire program nationwide with the requirement that all seven tactical recommendations identified are followed and implemented immediately by all Forest Service units across the country. These actions will ensure prescribed fire plans are up to date with the most recent science, that key factors and conditions are closely evaluated the day of a prescribed burn, and that decisionmakers are engaged in those burns in real time to determine whether a prescribed burn should be implemented.”

The seven recommendations in the report:

1. Each Forest Service unit will review all prescribed fire plans and associated complexity analyses to ensure they reflect current conditions, prior to implementation. Prescribed fire plans and complexity analyses will be implemented only after receiving an updated approval by a technical reviewer and being certified by the appropriate agency administrator that they accurately reflect current conditions.

2. Ignition authorization briefings will be standardized to ensure consistent communication and collective mutual understanding on key points.

3. Instead of providing a window of authorized time for a planned prescribed fire, agency administrators will authorize ignitions only for the Operational Period (24 hours) for the day of the burn. For prescribed fires requiring multi-day ignitions, agency administrators will authorize ignitions on each day. Agency administrators will document all elements required for ignition authorization.

4. Prior to ignition onsite, the burn boss will document whether all elements within the agency administrator’s authorization are still valid based on site conditions. The burn boss will also assess human factors, including the pressures, fatigue, and experience of the prescribed fire implementers.

5. Nationwide, approving agency administrators will be present on the unit for all high-complexity burns; unit line officers (or a line officer from another unit familiar with the burn unit) will be on unit for 30-40% of moderate complexity burns.

6. After the pause has been lifted, units will not resume their prescribed burning programs until forest supervisors go over the findings and recommendations in this review report with all employees involved in prescribed fire activities. Forest supervisors will certify that this has been done.

7. The Chief will designate a specific Forest Service point of contact at the national level to oversee and report on the implementation of these recommendations and on the progress made in carrying out other recommendations and considerations raised in this review report.

Chief Moore said two additional actions will occur by the end of this year:

  • Working with the interagency fire and research community and partners they will establish a Western Prescribed Fire Training curriculum to expand on the successes of the National Interagency Prescribed Fire Training Center headquartered in Tallahassee, Florida.
  • The Forest Service will identify a strategy, in collaboration with partners, for having crews that can be dedicated to hazardous fuels work and mobilized across the country to support the highest priority hazardous fuels reduction work.

Forest Service withdraws decision about 50,566-acre fuel treatment project in New Mexico

The U.S. Forest Service announced Tuesday that they are withdrawing the draft Decision Notice and Finding of No Significant Impact issued in March for the 50,566-acre Santa Fe Mountains Landscape Resiliency Project. It would involve prescribed fire and vegetation thinning treatments on 36,680 acres east of Santa Fe, New Mexico on a landscape scale. Each year at least 750 acres would have been thinned and up to 4,000 acres would have been treated with prescribed fire during a 15- to 20-year time frame.

On July 12 the Board of County Commissioners of Santa Fe County passed a resolution urging the FS to conduct a full Environmental Impact Statement (EIS) for a planned very large fuel management project. The FS went through the much less complicated Environmental Assessment (EA) process, which included the draft EA, public outreach, and accepting comments, then issued a Finding of No Significant Impact (FONSI) which they felt enabled the implementation of the project.

The statement issued by the Santa Fe National Forest dated July 26, 2022 said, “The SFNF is taking this step to reengage with our partners and community on this very important project to improve forest health in and around Santa Fe…Our intent is to reinitiate the decision and NEPA process for this project after the Chiefs 90-day pause with the publication of a legal notice in the Albuquerque Journal, the newspaper of record. If you previously submitted an objection to the final environmental assessment and draft notice of decision, you will need to resubmit your objection at that time.”

After three prescribed burning projects on the Santa Fe National Forest got out of control since 2018 and had to be converted to wildfires, some of the locals are worried about future projects on the forest.

The current 341,735-acre Calf Canyon / Hermits Peak Fire is the result of two prescribed fires that escaped control earlier this year on the Santa Fe National Forest. One was a broadcast burn that crossed control lines during strong winds. The other originated from slash piles that were ignited in late January that continued burning for months. In mid-April one or more of those piles became very active during strong winds and merged with the other escaped fire on April 22. The fire has destroyed at least 400 homes, forced up to 18,000 people to evacuate their properties, resulted in flooding, and cost more than $248 million in firefighting expenses.

In 2018 another pile burning project on the Santa Fe escaped months after it was ignited and had to be converted to a wildfire. A Facilitated Learning Analysis found that “communication” and “prescribed fire preparation and risk” were common themes.
